MYCHART TERMS OF USE

MyChart is provided by Eisenhower Health (“EH”) to its patients subject to compliance with the terms and conditions set forth below. Please read the following information carefully. Your continued use of MyChart will indicate your agreement to be bound by these terms of use. If you do not agree to be bound by these terms, please promptly exit and discontinue your use of MyChart. To deactivate a MyChart account, please contact the EH Health Information Management Department at 760-773-1298.

Emergency Situations

MyChart should never be used for urgent matters or emergency situations.The anticipated turnaround time for response to electronic messages is 1 to 3 business days. Therefore, for all urgent matters and emergency situations that you believe may immediately affect your health or well-being, you should, without delay, contact EH by phone, and/or go to the emergency department of a local hospital, and/or dial 911. If your provider is out of the office or unavailable, messages sent via MyChart may be routed to other authorized caregivers within EH in order to facilitate a timely response to your request.

Use of MyChart Information

MyChart displays certain health information from medical records, but it does not display all information from medical records. MyChart is not a substitute for appropriate and timely direct contact with your provider. You should never change or stop any course of treatment prescribed by your provider without first consulting him or her. EH assumes no responsibility for how you use the information you obtain from MyChart. Asking for advice on behalf of another person could potentially be harmful and is a violation of these terms of use. EH does not assume any responsibility for health information or services used by persons other than the MyChart enrollee.

Restrictions on Use

Access to the MyChart system is granted to users for the purpose of furthering their medical care. Use of the system unrelated to this purpose may result in the suspension or termination of access privileges. Improper activities that may lead to the suspension or termination of your MyChart access include, but are not limited to:

  1. Signing on as or pretending to be another person (refer to proxy access section below);
  2. Using language or transmitting material that is unlawful, obscene, defamatory, threatening, harassing, hostile, abusive, slanderous, hateful or embarrassing to any other person or entity (including EH personnel); or
  3. Uploading or transmitting any communications or content of any type that may infringe or violate any rights of any party;
  4. Using MyChart for any purpose in violation of local, state, national or international laws;
  5. Using MyChart as a means to distribute advertising or other unsolicited material to any third party;
  6. Any drug seeking behavior;
  7. Sharing your password with another person or misusing or abusing your MyChart access privileges;
  8. Interfering with the proper working of this website including, but not limited to, the transmission of any virus, worm, trap door, back door, timer, clock, Trojan horse, or other limiting routine, instruction or design.

Eisenhower Health expressly reserves the right, in its sole discretion, to terminate or limit a user's account due to any act delineated above, any other act that would constitute a violation of these Terms and Conditions, or at the discretion of the patient's physician or practice manager. Eisenhower Health may limit a user's MyChart account by enabling "view only" access or terminating access to interactive services and/or any or all other areas of MyChart.

Eligibility and Access to Family’s Health Information

  1. Adults 18 years of age or older

    To be eligible to participate in MyChart, you must meet the minimum age requirements, and you must be an active patient of a EH health care provider. An EH patient may request for an individual to have proxy access to his or her MyChart account (see proxy access section below).

  2. Minors between ages of 12 and 18

    An individual must be at least age 12 years of age or older to request a personal MyChart account. Parents or guardians of minor children may request access to the minor child's account by following the terms outlined in the "Proxy Access" section below. Under state and federal law, there are certain types of medical information that the parent or guardian of a minor patient age 12 or older may not view without consent of the minor patient. Because of these requirements, this information will not be viewable on MyChart and may only be requested directly from EH Health Information Management by the patient or by any other individual authorized to do so under federal and state privacy laws. EH will request documentation as it deems necessary to determine whether proxy access should be granted.

    If you have been granted access to a minor patient's record through MyChart and your legal relationship with the patient changes, you must inform EH immediately. Please call Health Information Management Department at (760) 773-1298. EH reserves the right to revoke proxy access to a patient's MyChart record at any time for any reason.

  3. Minors under age 12

    Only parents or legal guardians of minor children under the age of 12 may request access to the minor child's information available through MyChart. In such cases, the party requesting access must demonstrate the legal right to that access. EH will request documentation as it deems necessary to determine whether proxy access should be granted.

    If you have been granted access to a minor patient's record through MyChart and your legal relationship with the patient changes, you must inform EH immediately. Please call Health Information Management Department at (760) 773-1298. EH reserves the right to revoke proxy access to a patient's MyChart record at any time for any reason.

  4. Disabled Patients over the age of 18 –- Surrogates with decision-making responsibilities for disabled patients 18 or older may request access to the patient’s account. In order to secure access to the disabled patient’s MyChart account, surrogates need to contact the EH Health Information Management Department in order to secure proxy rights for the patient. EH will request documentation as it deems necessary to determine whether proxy access should be granted. Access will only be granted to parties with surrogate decision-making responsibilities over the EH MyChart account holder and only to the extent that the party requesting access can demonstrate the legal right to that access.

    If you have been granted access to a disabled patient's record through MyChart and your legal relationship with the patient changes, you must inform EH immediately. Please call Health Information Management Department at (760) 773-1298. EH reserves the right to revoke proxy access to a patient's MyChart record at any time for any reason.

MyChart ID and Password

In order to access MyChart, you will need to create a unique identification (ID) code and password. This ID and password are unique codes that identify you in the MyChart system. Inquiries and entries that you make via MyChart will be logged with your identity. You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your EH online password or account. It is your sole responsibility to (1) control the disclosure and use of your activation codes, username and password; (2) authorize, monitor, and control access to and use of your EH MyChart account and password; and (3) promptly change your password in EH MyChart if it has been compromised. EH takes no responsibility for and disclaims any and all liability or damages of any kind arising from a breach of medical record confidentiality resulting from you sharing or losing your password. If EH discovers that you have inappropriately shared your password with another person, or that you have misused or abused your MyChart access privileges in any way, your participation in MyChart may be discontinued by EH without prior notice.

Proxy Access

Proxy access allows you to securely communicate with the patient's provider’s office on behalf of a family member or person under your care. This communication is done using a MyChart Account and is restricted to non-urgent matters. Proxy access forms can be found on Eisenhower’s MyChart site or the Medical Records page at eisenhowerhealth.org. You may also request a Proxy form by emailing HIM_MyChart@eisenhowerhealth.org. Proxy access is granted once an authorization form has been completed and processed by the Health Information Management Department. A MyChart account will be activated for both the proxy and the patient. If the proxy’s legal relationship with the patient changes, the proxy must inform EH Health Information Management immediately by calling (760) 773-1298 or sending written notice to Health Information Management, Eisenhower Medical Center, 39000 Bob Hope Drive, Rancho Mirage, California 92270. The decision to grant proxy access shall be made at EH’s sole discretion based on the individual circ*mstances surrounding the request and as allowed by applicable law EH reserves the right to revoke proxy access at any time for any reason. Nothing herein shall be interpreted to require EH to provide proxy access to any individual regardless of whether such access would be allowed under applicable law.

MyChart Messaging and Communications

We are only able to respond to electronic communications through MyChart based on the information you provide. If there is insufficient information provided, we will be unable to provide accurate and reliable services. EH may send you messages via MyChart. These messages may contain information that is important to your health and medical care. It is your responsibility to monitor these messages.

By entering your valid and functional email address you have enabled EH to notify you of messages sent to your MyChart Inbox. If your contact information changes, please update this as soon as possible on MyChart. All communication through MyChart will be in regard to your own health condition(s). The contents of these messages may be stored in your permanent medical record.

Your health care provider may choose to select an associate to help manage and respond to your messages. These may include nursing or other administrative staff who review messages sent via MyChart and either respond or route the message to the health care provider. Therefore use of MyChart secure messaging may not be appropriate if the message includes sensitive information that you would only wish to discuss directly with your provider.

Messages you send via MyChart become part of your permanent legal medical record at the discretion of the physician or support staff. Once a message is made part of your permanent medical record, it will be accessible to current and future health care provider(s) and staff members who are appropriately involved with your care. These communications may also be released to authorized third parties in accordance with our Notice of Privacy Practices.

Complete Medical Record

The electronic medical record is the property of EH. The information displayed in MyChart does not represent the complete medical record , e.g., diagnostic images, scanned documents or information maintained in other systems. Posting of information into MyChart is at the discretion of your individual health care providers(s) and our organization. Contact our Health Information Management Department at 760-773-1211 for official copies of medical records not viewable in MyChart or in regard to discrepancies or potential errors with the medical information listed in your record.

Privacy

Eisenhower Health will use your confidential medical information in order to provide you with health care services. Eisenhower Health will, at all times, maintain your confidential medical information in strict confidence and will only disclose such information as permitted by applicable law. Please review Eisenhower Health’s Notice of Privacy Practices for a thorough description of how we gather, use and protect your confidential medical information. All messages sent and received within MyChart that contain medical information are subject to all state and federal laws governing the security and confidentiality of medical records.

Additional Security

For additional Security, Eisenhower recommends enabling two factor authentication on your MyChart account and/or personal email. Availability and use may vary by email provider.

Disclaimer

MyChart may not be available to you due to system failures, back-up procedures, maintenance, or other causes beyond the control of EH. Access is provided on an “as-is, as-available” basis and EH does not guarantee that you will be able to access MyChart at any particular time. EH TAKES NO RESPONSIBILITY FOR AND DISCLAIMS ANY AND ALL LIABILITY ARISING FROM ANY INACCURACIES OR DEFECTS IN SOFTWARE, COMMUNICATION LINES, VIRTUAL PRIVATE NETWORK, THE INTERNET OR MY INTERNET SERVICE PROVIDER (ISP), ACCESS SYSTEM, COMPUTER HARDWARE OR SOFTWARE, OR ANY OTHER SERVICE OR DEVICE THAT YOU USE TO ACCESS MYCHART. During times when MyChart is unavailable, other communication methods (e.g., telephone) should be used to communicate with EH or your physician.

MyChart Authentication for Third-Party Applications

You may be asked to provide your MyChart login credentials to connect third-party applications to information available in your EH medical record. These applications may leverage your personal health information to deliver goods and services to you. The information accessed by these applications may include some or all of the following information:

  • Allergies, Demographics, Health Goals, Implants, Medications, Problems, Immunizations, Care Team, Documents, Health History, Lab Results, Plan of Care, Procedures, Vital signs

These applications are not created or managed by EH. Whether you grant or deny access to these applications will not impact your ability to receive medical care at EH. If you approve requests by these applications, you allow third parties (the applications, their developers and their associates) to access your personal health information. Note that these third parties may not be obligated to protect your health information under the same privacy regulations as EH and your health care providers. Some applications may use your personal health data for advertising or secondary purposes.

When granting access to these applications, you may be providing access to information that could potentially reveal your diagnosis or treatment for drug and alcohol abuse, your mental health status, your HIV status, and/or results of your genetic testing, if applicable. By authorizing access to these third party applications, you assume the risks of disclosure of such information.

We advise that you carefully review each application’s Terms and Conditions and be sure that you are comfortable with how each application will use your data before granting access.

Ownership of Proprietary Materials

The content on MyChart is provided for EH and its patients only. Nothing on this Site should be construed as granting any license or right to use any trademark, service mark, or logo displayed on MyChart without the express permission of EH or the third party that may own the trademark, service mark, or logo.

Indemnification

To the fullest extent permitted by law, you shall defend, indemnify, and hold harmless EH, its employees, directors, officers, agents, and subcontractors from and against all claims, including any liability or expense, losses, damages (actual or consequential), suits, judgments, litigation costs and attorneys’ fees, arising from or in any way related to your use of MyChart or any information you obtain from MyChart, a violation by you of these terms of use, or your failure to read any MyChart messages or communication in a timely manner. EH will provide prompt written notice of any such claims, but failure to provide such notice will not release you from any of your obligations pursuant to these terms of use except to the extent that you are actually prejudiced by such failure.

Additional Terms

These terms of use shall be governed by the laws of the State of California and any dispute arising hereunder must be submitted to binding arbitration in Riverside County, California in accordance with the rules of commercial arbitration of the Judicial Arbitration and Mediation Service. These terms of use contain the entire agreement between the parties with respect to the subject matter contained herein and it shall not be modified or amended except by signed written instrument. These terms of use may be changed at any time in the discretion of EH and updated terms will be posted on the MyChart website for user access.
